Former 'hanging judge' to preside over Trillanes amnesty case in SC

A FORMER  'hanging judge' will handle the petition, which Sen. Antonio Trillanes 4th filed before the Supreme Court, to stop President Rodrigo Duterte from revoking his amnesty and consequently ordering his arrest.


Associate Justice Diosdado Peralta will preside over Trillanes' case following a special raffle today, Friday, 07 September 2018.

The camp of embattled Senator Antonio Trillanes 4th on Thursday trooped to the Supreme Court (SC) to stop President Rodrigo Duterte's revocation of his amnesty and prevent his arrest. 

A lawyer for the opposition lawmaker and strident Duterte critic, who was holed up at his Senate office, filed a petition for certiorari or review and prohibition and sought a temporary restraining order or writ of preliminary injunction.


Reynaldo Robles, Trillanes' lawyer, was accompanied by former congressman Ashley Acedillo, a former Magdalo mutineer like Trillanes, to show documents that they have complied with the requirements for their amnesty during the Aquino administration.

As of posting time, Trillanes is still awaiting the Supreme Court's action on his petition for a temporary restraining order (TRO) against Proclamation 572, which was published in the Classified Ads section of The Manila Times on Tuesday.

Without a TRO, Trillanes is expected to sleep in the Senate over the weekend.

The SC will hold its regular en banc session on Tuesday.

Peralta is currently the third most senior justice and chairperson of the high tribunal's 3rd Division.

A graduate of the University of Santo Tomas (UST) College of Law, Peralta entered the government and served as a prosecutor of Manila.  He then became a judge of the Quezon City Regional Trial Court (RTC).  He was promoted to the Sandiganbayan and became presiding justice before appointed to the high court.

Peralta earned a reputation for being a "hanging judge" because he sentenced more than 40 people to death when he was Quezon City RTC judge, according to reports. [Jomar Canlas, The Manila Times]
